1. Governing Law

These Terms and Conditions are governed by the laws of Tasmania and the Commonwealth of Australia.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies available under the Australian Consumer Law.

2. Nature of Services

Awaken & Reclaim Transformational Hypnotherapy provides complementary hypnotherapy services designed to support behavioural change, emotional regulation, confidence, personal growth, and transformation.

Services are not medical, psychiatric, or psychological treatment. Services do not provide diagnosis and do not replace care from a GP, psychologist, psychiatrist, or other qualified health professional.

You remain responsible for your own medical and mental health care.

3. Eligibility

Services are available to individuals aged 18 years and over.

By booking, you confirm that:

• You are over 18
• You are participating voluntarily
• You have the capacity to provide informed consent

4. Bookings, Fees & Payment

Payment is required prior to or at the time of each session unless otherwise agreed in writing.

Fees are charged at the rate displayed at the time of booking or purchase.

Fees will not be retrospectively recalculated or adjusted once paid, except where required under the Australian Consumer Law.

5. Cancellation & Rescheduling

A minimum of forty eight (48) hours notice is required to cancel or reschedule an appointment.

Appointments cancelled with less than forty eight hours notice, or missed without notice, may result in forfeiture of the full session fee or deduction from any prepaid package.

Appointment reminders may be sent as a courtesy. Failure to receive a reminder does not waive or modify this policy.

In cases of genuine emergency, the practitioner may, at their sole discretion, offer rescheduling. Where appropriate, supporting documentation such as a medical certificate may be requested.

Any exception granted is a gesture of goodwill and does not create an ongoing entitlement or precedent.

6. Prepaid Packages

Prepaid packages must be used within six (6) months of purchase unless otherwise agreed in writing.

Packages are non transferable.

Missed sessions and late cancellations may be deducted from prepaid sessions.

Unused sessions after six months will expire and are not refundable.

Once the first session of a prepaid package has commenced, the package is non refundable, except where required under the Australian Consumer Law.

7. Refunds & Australian Consumer Law

Refunds will be provided where required under the Australian Consumer Law.

If a service fails to meet consumer guarantees under Australian law, you may be entitled to a remedy including a refund or other appropriate remedy.

Nothing in this policy excludes, restricts, or modifies your rights under the Australian Consumer Law.

Fees for individual sessions are not refundable once the session has been delivered, except where required under the Australian Consumer Law.

8. Online Sessions

Online sessions are conducted via secure third party platforms such as Zoom.

While reasonable steps are taken to protect confidentiality, absolute security of electronic communication cannot be guaranteed.

Clients agree to attend online sessions from a private and safe environment, not while driving or operating machinery, and with adequate internet access.

Services are delivered within Tasmania, Australia and are governed by Australian law regardless of the client’s location.

9. Confidentiality & Privacy

Personal information is collected and managed in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

Information shared during sessions is treated as confidential except where disclosure is required or permitted by law, including:

• Serious and imminent risk of harm
• Mandatory reporting obligations
• Court orders

Clinical records are stored securely and retained in accordance with Australian legal requirements.

Electronic communication carries inherent privacy risks. By contacting us electronically, you acknowledge this risk.

10. No Guarantee of Results

Individual results vary. No specific outcome, result, or timeframe is guaranteed.

Participation in hypnotherapy requires personal commitment and responsibility for behavioural change and integration of tools provided.

11. Intellectual Property

All scripts, recordings, written materials, templates, branding, website content, and therapeutic resources remain the intellectual property of Awaken & Reclaim Transformational Hypnotherapy.

Materials are provided for personal use only and may not be reproduced, distributed, recorded, published, shared publicly, or used for commercial purposes without prior written consent.

12. Website Use

You agree not to:

• Copy or republish website content
• Use content for commercial purposes
• Misrepresent affiliation with Awaken & Reclaim
• Use this website in any unlawful manner

We reserve the right to modify, suspend, or remove website content at any time without notice.

13. Practitioner Discretion

Awaken & Reclaim reserves the right to refuse, pause, or discontinue services where continuation is assessed as unsafe, clinically inappropriate, outside scope of practice, or where professional boundaries are not respected.

Termination does not waive any outstanding fees owed.

14. Limitation of Liability

To the fullest extent permitted by law, liability arising from services is limited to the total fees paid for those services.

We are not liable for indirect, consequential, or reliance based loss arising from participation in services.

Nothing in these Terms excludes or limits rights under the Australian Consumer Law.

15. Amendments

We reserve the right to amend these Terms at any time.

Updated Terms will be published on this website with a revised date.

Continued use of the website constitutes acceptance of updated Terms.
